1. Business Information

These Terms and Conditions govern use of the Chelmsford Militaria website and all purchases made from Chelmsford Militaria.

Throughout these Terms and Conditions, “Chelmsford Militaria”, “we”, “our” and “us” refer to the seller. “Customer”, “you” and “your” refer to the purchaser.

2. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms shall be subject to the jurisdiction of the courts of England and Wales, except where applicable consumer law permits a consumer to bring proceedings in another part of the United Kingdom.

3. Acceptance of Terms

By accessing our website, registering an account, placing an order or purchasing any product from Chelmsford Militaria, you confirm that:

You have read and understood these Terms and Conditions.

You are legally capable of entering into a binding contract.

Where applicable, you meet all age and legal requirements necessary to purchase the relevant product.

You will comply with all applicable laws relating to possession, ownership, transportation and use of any item purchased.

4. Age-Restricted Products

Certain products are available only to persons aged 18 years or over. These may include deactivated firearms, bayonets, knives and edged weapons, certain inert ammunition items and replica firearms.

By purchasing an age-restricted product, you warrant that you are at least 18 years of age, are legally permitted to possess the item, and are not subject to any restriction preventing ownership.

We may request satisfactory proof of age and identity before accepting or dispatching an order.

We may refuse or cancel an order where age or legal compliance cannot be established.

Age-restricted goods will only be delivered using an appropriate delivery method where required.

5. Firearms and Weapons Compliance

Customers are responsible for complying with all legislation applicable to the purchase, possession, transfer, transport and use of the relevant item, including the Firearms Act 1968 and subsequent amendments, the Policing and Crime Act 2017, the Firearms Regulations 2019, the Offensive Weapons Act 2019 and any replacement or amending legislation.

Where the law requires notification of a transfer of a deactivated firearm, you authorise Chelmsford Militaria to provide the required purchaser and item information to the Home Office or another competent authority. You must provide complete and accurate information for that purpose.

You must not reactivate, convert, modify or attempt to modify any item unlawfully. We may refuse a transaction or report relevant information where required by law.

6. Product Descriptions and Condition

We take reasonable care to describe and photograph products accurately. Many products are historical items, antiques or collectables and may show age, wear, corrosion, repairs, replacement parts, markings, variations or other imperfections consistent with their history.

Photographs form part of the description, but colour and appearance may vary between displays.

Measurements and dates are approximate unless expressly stated otherwise.

Condition assessments are opinions based on reasonable inspection and are not guarantees.

No item is represented as suitable for a particular purpose unless we expressly confirm this in writing.

7. Historical and Political Material

Items bearing historical insignia, emblems, markings or symbols are offered solely as collectables, historical artefacts, educational objects, display pieces or props. Their sale does not constitute endorsement of any political ideology, organisation, regime, rhetoric or conduct associated with their original use.

8. Prices and Availability

Prices are shown in pounds sterling and include VAT where applicable unless stated otherwise.

Delivery charges and any other applicable charges will be shown before the order is submitted.

All products are subject to availability.

We may correct an obvious pricing or description error. If an order is affected, we will contact you and may cancel it and refund sums paid.

9. Orders and Formation of Contract

An order is an offer to purchase. An automated acknowledgement confirms receipt only and does not mean that the order has been accepted. A binding contract is formed when we expressly accept the order or dispatch the goods, whichever occurs first.

We may decline an order for a lawful reason, including lack of stock, inability to verify age or identity, suspected fraud, legal restrictions, delivery limitations or an obvious pricing error.

10. Payment and Title

Payment must be made using a method offered at checkout or otherwise agreed by us. Goods remain our property until payment has been received in full and cleared. This does not affect when risk passes under clause 11.

11. Delivery, Inspection and Risk

Delivery dates are estimates unless we expressly agree a guaranteed date.

You must provide a complete and accurate delivery address and any information required for lawful delivery.

Risk passes to a consumer when the goods come into the physical possession of the consumer or a person identified by the consumer to take possession.

Please inspect goods promptly and notify us without undue delay of loss, damage, an incorrect item or an apparent defect. This request does not reduce your statutory rights.

12. International Orders and Export

International customers are responsible for checking import, export, licensing, customs and possession requirements before ordering. An order may be refused where lawful shipment cannot be confirmed. The customer is responsible for customs duties, import VAT, taxes and charges unless expressly stated otherwise.

Nothing in this clause excludes any liability that cannot lawfully be excluded. We will not knowingly dispatch goods where the transaction or export would be unlawful.

13. Consumer Cancellation Rights

If you are a consumer purchasing at a distance, you may have a statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where the right applies, the normal cancellation period is 14 days beginning the day after you, or a person nominated by you, receives the goods.

To cancel, send a clear statement to james@chelmsfordmilitaria.com or to our postal address. You must then return the goods within 14 days after notifying us. Unless the goods are faulty, not as described or we agree otherwise, you are responsible for the direct cost of return.

You may examine goods as you would in a shop. We may make a lawful deduction from a refund for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Statutory exceptions may apply, including to goods made to your specification or clearly personalised. Any exception will be applied only where permitted by law.

14. Returns, Faulty Goods and Refunds

Before returning an item, contact us and quote your order details. Goods should be securely packaged and returned with proof of purchase. You retain all rights and remedies available under the Consumer Rights Act 2015.

Where goods are faulty, not as described or otherwise fail to conform to the contract, remedies may include repair, replacement, price reduction or refund depending on the circumstances and applicable law. Nothing in these Terms restricts your statutory rights.

15. Business Customers

If you purchase wholly or mainly for business purposes, you confirm that you have authority to bind that business. Consumer-only cancellation rights do not apply. To the extent permitted by law, implied terms are excluded and our total liability arising from the relevant order shall not exceed the price paid for the affected goods, except for liability that cannot legally be limited or excluded.

16. Prohibited Use

Do not reactivate, convert or modify an item to create a functioning firearm or prohibited weapon.

Do not use, transfer, transport, resell or export an item unlawfully.

Do not provide false identity, age, address or licensing information.

Do not use our website in a way that is fraudulent, harmful, unlawful or infringes another person’s rights.

17. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights, or any other liability that cannot lawfully be excluded or limited.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for business losses suffered by a consumer.

If you are a business customer, clause 15 applies in addition to this clause.

18. Intellectual Property

Website content, including text, branding, product descriptions, photographs and layout, is owned by or licensed to Chelmsford Militaria and is protected by intellectual property law. It may not be copied, reproduced, republished or commercially used without prior written permission, except as permitted by law.

19. Privacy and Regulatory Disclosures

We process personal information in accordance with our Privacy Policy, applicable UK data protection law, including the UK GDPR and Data Protection Act 2018, and any legal obligation applying to regulated or age-restricted products. Information may be disclosed to law-enforcement, the Home Office, regulators, delivery providers or professional advisers where required or permitted by law.

20. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by an event outside our reasonable control. This may include severe weather, fire, flood, war, terrorism, industrial action, transport disruption, cyber incidents, supply-chain failures, acts of government or changes in law. We will take reasonable steps to minimise the effect and will comply with any non-excludable consumer obligations.

21. Complaints

Please send complaints to james@chelmsfordmilitaria.com or to our postal address, quoting your name, order number and a clear description of the issue. We will seek to resolve complaints fairly. Nothing in this process prevents you from exercising statutory rights or bringing a claim.

22. Changes to These Terms

We may update these Terms from time to time. The version applying to an order is the version made available when the order was placed, unless a change is required by law or agreed with you.

23. General

If a court finds part of these Terms unlawful or unenforceable, the remaining provisions continue in effect.

A delay in enforcing a right does not waive that right.

No person other than the parties has a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

These Terms, together with the order confirmation and policies expressly incorporated into them, form the agreement relating to the sale.
